Job Role : Vice President Commercial Contracts
Manage end-to-end tendering process for ownportfolio, from RFP development / review till the appointment ofconsultant or contractor.
Assist in managingthe contractor pre qualification, completion of tender documents,bid evaluations, finalizing contract documents, contract controlsand contract administration.
Review claims,VOs, bonds, warranties, accounts and close outdocumentation.
Monitor compliance withcontractual terms, DoA and P&Ps.
ROLES ANDRESPONSIBILITIES Tendering :
Manage the tendering process from planning& prequalification until award, ensure it is implemented asper the procurement policy and procedures.
Review / submit tender-related scope templates(consultants and contractors) and associated documentation tocomply with latest Laws, regulations, Policy & Procedures,and liaise with Legal and Finance Departments.
Functionally review project scope received from PMC orother Users (e.g., Development Management) and liaise with theUsers to develop and maintain scopes of work samples for issue inRFPs.
Support Development and Projectmanagement teams in preparation of Project Procurement Strategies(and packages)
Ensure the tendering processfor cost recoverable assets abide by the relevantauthorities’ guidelines and standards.
Review and recommend prequalification and technicalevaluation criteria and ensure that these are in line with Companystandards.
Review short-listed biddersidentified by User & Vendor-list Prequalification andobtain Expression of Interest .
Liaise with the Users to arrange for site visits andpre-bid meetings and prepare and issue minutes of Meetings to allbidders.
Coordinate and participate in tenderopening of technical and commercial proposals
Liaise with Project management teams (and PMC) and otherUsers for bid technical clarification requests / evaluation andPerform clarification requests / commercial evaluation for bids oftechnically acceptable bidders.
Seekassistance from Cost Estimation and project teams and PMC (ifrequired) to evaluate bidders’ orsub-contractors’ priced proposals (quotations) fortenders.
Support Users on technicalnegotiations and lead commercial negotiations with bidders tosecure the most competitive offers that provide the Company withthe best value for money without risk exposure.
Contract variation approvalprocess
Develop andmaintain contract related forms templates and checklist linked toautomated filing systems for easy retrieval, and to satisfy Legaland Audit requirements.
Provide timelyadministrative support and contractual advice for all contractmanagement activities such as contract termination, suspension,claims, variations, close-outs and extensions.
Provide input to Cost Estimation and cost control inprocessing payments by providing required contractualadvice.
Identify breaches in contract delivery :
Solicit feedback from end users (Project Managers) toidentify breachesAssist in performing root cause analysis toidentify source of breach and recommended action.
Coordinate and followup with vendors and Project Managersto ensure seamless execution of contracts / scope of work :
If required by stakeholders, report contractorcontractual adherence to Project Managers accurately and in timefor required actions.
Ensure all contractualchanges are tracked and documented by variation orders.
Manage end-to-end Variation Order process asfollows :
Assess, analyze, and recommendVariation Orders to management for approval.Liaise with DevelopmentManagement, Project Management and Project ControlsGather inputfrom Cost Estimation to estimate the cost impact of the VariationOrders and ensure that it has been considered.
Perform any additional related tasks / activities asdirected by the SVP Commercial Contracts.
RELATED YEARS OFEXPERIENCE
Min of : 10years of experience.
YOE IN MANAGERIALPOSITION
Min of : 2years in a managerial position leading a procurementfunction.
Tenderingand Contract administration preferably with a large real estatecompany with annual revenue of at least AED 2 billion.
